Martin Bischoff helps creditors protect their legal rights and enforce their contractual obligations. Our attorneys have many years of experience in representing businesses, corporations, banks, and financial institutions in a wide variety of business transactions, contract disputes and litigation, collections, foreclosures, loan workouts and bankruptcy proceedings.

We have attorneys licensed to practice law in state and federal courts in Oregon, Washington, Alaska, and are regularly associated as counsel to assist creditor clients in many other states throughout the country. We routinely handle and pursue claims on behalf of our creditor clients.

In addition to pursuing our clients' claims, we defend our creditor clients in lawsuits alleging lender liability claims and violations of consumer protection laws such as the Federal Truth and Lending Act, including Regulation Z, the Fair Credit Reporting Act, the Equal Credit Opportunity Act, the Fair Debt Collection Practices Act, the Unlawful Debt Collection Practices Act, and state and federal RICO statutes. Cases in which we have been involved include the defense of a national bank in a nationwide class action alleging violations of various credit laws and other laws.

Perhaps even more important to our clients than the litigation services we provide is our advice to them on steps which they can take to avoid problems in the first place. For example, we review and draft contracts for our clients and counsel them on contract terms they need to protect their interests in the event of a default. We also advise financial institutions on compliance with the Federal Truth and Lending Act, including Regulation Z, the Fair Credit Reporting Act, the Equal Credit Opportunity Act, and the Fair Debt Collection Practices Act, and the Unlawful Debt Collection Practices Act.

• Representation of a nationally known receiver in connection with the liquidation of one of the largest commercial nurseries in the United States.
• Representation of a national automobile financing corporation in a lawsuit to enforce its security interest in the assets of one of its dealerships.
• Representation of a national mortgage company in various foreclosure and bankruptcy proceedings in western states, including complex foreclosure and bankruptcy proceedings involving a Superfund site in Arizona.
• Representation of creditors in bankruptcy proceedings instituted by one of Oregon's largest home furnishings dealers.
